Summary:
The plaintiff lost money in a land deal in which Deans, of the defendant law firm, acted as a conveyancer. The plaintiff commenced a negligence action for damages against the law firm.
The Manitoba Court of Queen's Bench held that Deans was negligent and 50% responsible for the plaintiff's loss. The court assessed damages accordingly.

Negligence - Land transfers - Barber operated a land transfer scheme where by land was "flipped" back and forth to artificially inflate the price - A lawyer, Deans, was retained to see that purchasers of the land obtained their certificates of title - He had no contact with the purchasers and did not advise them - Although Deans became aware that the scheme might be illegal, he continued to do the conveyancing for some time - A purchaser who lost money in this scheme sued Deans - The Manitoba Court of Queen's Bench held that Deans was negligent and 50% at fault for the purchaser's loss for not ceasing to act once he became aware of Barber's scheme - The court held that the purchaser was also 50% at fault for failing to act prudently.
