A new online platform called the ‘Federal Learning Account’ (FLA) has been launched to govern employee training rights. This platform’s main purpose is to provide information to employees regarding their training entitlements. The FLA, which is introduced via the FLA Act 2023, triggers several administrative obligations for employers as they will be required to supply or verify the information in the FLA. #Arbitration in Rwanda - As reported in the Global Arbitration Review, the High Court of Rwanda has set aside a US$32 million UNCITRAL against the Rwanda Energy Group, a state-owned entity. The court found that the award was contrary to #PublicPolicy in light of the claimant’s subsequent conviction for bribery and corruption.   Liedekerke is present in Rwanda through Liedekerke Great Lakes, our subsidiary in Kigali. "Speed dating for all legal matters related to ESG”, that is how one of our speakers described the ESG Breakfast Seminar.   More than one hundred professionals gathered this past Thursday morning in the Hilton Grand Place hotel to listen to Bruno Aguirre, Francesca Biebuyck, Jasper Bossuyt, Wim Dedecker, Bruno Hardy, Vincent MUSSCHE, Gabriele Ruscalla, Joëlle Thambwe, Tom Van Dyck, Sarah van den Brande, Margot Vandebeek, Thomas Verbergt and Louise Verstraete. Each speaker had six minutes to talk about ESG in relation to their specialty of law. These enlightening sessions were preceded by a keynote speech by Benoît van den Hove, CEO of Euronext, who gave a fascinating talk about sustainable finance.   We are very proud to host these sessions that manage to go into depth on very different topics in very little time. According to the Product Liability Act of 25 February 1991, which implements the Product Liability Directive of 1985, damage caused by defective products can be compensated by the producer (or in some cases the supplier) without the victim having to prove a fault.   In a noteworthy judgment of 14 March 2024 (C.23.0100.N), the Belgian Cour de cassation ruled that the Product Liability Act of 25 February 1991 limits the application of the extra-contractual fault liability (currently articles 1382 and 1383 Old Civil Code, as from 2025 article 6.5 Civil Code). The “Greenwashing Directive” has been formally signed on 28 February 2024 by the Presidents of the EU Parliament and of the Council, and has been published on 6 March 2024 in the Official Journal of the EU Parliament. The Directive aims at providing consumers with additional information regarding the environmental impact of specific products, and protecting them against deceptive commercial practices concerning the sustainability aspects of said products. The countdown has now begun: starting from its entry into force on 26 March 2024, the EU Member states have to transpose the Directive into their national laws within 24 months (i.e. by 27 March 2026), and apply the provisions as from 27 September 2026.
